Conditions of Sale

Definitions

i. 'The Seller' means Wilkins Packaging Ltd.
ii. 'The Buyer' means the person, firm, or company shown as the customer.
iii. 'The Goods' mean the goods sold to the buyer by the seller.
iv. 'The Recipient' means the person, firm or company to whom the goods are delivered when its no the buyer.

Receipt

The Buyer or recipient shall receive the goods detailed on the sellers documentation, it is the responsibility to check the quantity and conditions of the good and endorse the sellers documentation if there are any shortages or unsatisfactory goods. The buyer must inform the seller separately within three days of receipt of any such unsatisfactory goods or shortage. Any claims after this period cannot be entertained.

Title to the Goods

The goods shall remain the property of the Seller until such time as the price of the said goods has been paid in full by the Buyer to the Seller or his appointed agent. At such time the goods become the property of the Buyer along with all attending risks.

Price

The price charged shall be the price ruling at the time of delivery.

Payment

All online credit card payments are made via an encrypted Secure Socket Layer (SSL) server. Any personal information collected on the customer is kept private from any other company or party.

Acceptance of Terms

Payment of any invoice shall imply acceptance buy the Buyer of the Sellers conditions of sale.

Signature for Goods

The recipient or Buyer is obliged to examine the goods at the time of receipt, that persons signature becomes effective immediately after the physical hand over of the goods.

Amendments

The seller reserves the right to alter,change or amend, without prior notice, any other conditions of sale.

The Contract

Unless otherwise expressly agreed in writing by the Seller these Conditions of Sale override any terms and conditions stipulated, incorporated or referred to by the buyer in his order or negotiations. These Conditions of Sale embody the entire understanding of the Seller and Buyer and supersede any prior promises, representations, understanding or implications. No variation of these Conditions of Sale shall be effective against the Seller unless expressly agreed in writing and signed by a duly authorised employee of the Seller on its behalf.

Delivery

(a) In no case is delivery on or by a fixed date a terms of the contract. Failure to deliver by the quoted or specified time shall not be ground for cancellation or refusal to take delivery or entitle the buyer to any claim by reason of such failure.

(b) The risk in the goods shall pass to the Buyer on delivery and the Buyer should arrange Insurance Accordingly.

Other Variations

On any sale, whether or not by sample, the Seller reserves the right:

(a) To deliver quantities within a fifteen per cent margin of those ordered and to vary the price accordingly.
(b) to meet the Buyer's specifications as to colour and size subject to reasonable commercial variation at the price quoted.

All quantities stated on packs are approximate only. All shortages will be made goods in the final total.

On any sale whether or not by sample specifications or statements as to thickness or other dimensions of goods are given and accepted as estimates only. The Buyer accepts that the thickness and other dimensions of any goods supplied are liable to vary within the tolerances set out in the Packaging and Industrial Films Association Standard 6/83. The Buyer agrees that variations within such tolerances do not constitute a failure or refusal on the part of the seller to supply goods complying with the contract.

Carrriage Charges

£10.00 +VAT will apply. (2 day service)

Next day deliveries are £15.00 +VAT.
